Terms & Conditions – Australia

1. Promoter

The Australian portion of the Charlie Bears Mystery Box Unboxing Prize Draw (the “Prize Draw”) is promoted by:

(“Charlie Bears”, the “Promoter”, “we”, “us” or “our”).

The Prize Draw forms part of a global Charlie Bears promotion operating across participating Charlie Bears regions.

2. Promotion Period

The global Prize Draw opens at:

1:00pm BST on 23 September 2026

and closes at:

11:59pm BST on 1 October 2026

(the “Promotion Period”).

For Australian entrants, this corresponds to:

Opening – 23 September 2026

10:00pm AEST
9:30pm ACST
8:00pm AWST

Closing – 2 October 2026

8:59am AEST
8:29am ACST
6:59am AWST

The BST opening and closing times stated above will determine whether an entry has been received within the Promotion Period.

All qualifying main entries and Bearhouse Community bonus entries must be submitted during the Promotion Period.

Entries received after the closing time will not be accepted.

3. Eligibility

The Australian portion of the Prize Draw is open to residents of Australia aged 18 years or over at the time of entry.

The Prize Draw is open to eligible residents of all Australian states and territories, subject to applicable law.

Employees, officers and directors of:

Charlie Bears Collectables Australia Pty Ltd;
Charlie Bears Limited;
Charlie Bears North America Inc.;
their respective parent companies, subsidiaries and affiliates;
agencies involved in administering or promoting the Prize Draw; and
anyone directly involved in conducting the Prize Draw

are not eligible to enter.

Immediate family members and members of the same household as persons directly involved in conducting or determining the outcome of the Prize Draw may also be excluded where required by applicable law.

The Promoter may request reasonable evidence confirming an entrant's identity, age, Australian residence and eligibility before awarding the prize.

4. Qualifying Mystery Box Purchase

Australian entrants must purchase a qualifying Charlie Bears Mystery Box during the Promotion Period to enter through the Australian promotional entry method.

A qualifying Mystery Box may be purchased from one of the following participating official Charlie Bears websites:

Charlie Bears Australia – charliebears.com.au
Charlie Bears UK – charliebears.co.uk
Charlie Bears USA – charliebears.com

Purchases made through independent retailers, marketplaces, other third-party sellers or physical retail locations do not qualify unless expressly stated otherwise by Charlie Bears.

No separate entry fee is charged.

The normal selling price of the qualifying Mystery Box has not been increased, supplemented or otherwise adjusted to reflect participation in the Prize Draw or the opportunity to win the prize.

Entrants should retain their order confirmation or other proof of purchase.

Charlie Bears may request an order number or other reasonable evidence confirming that the Mystery Box featured in an entry was a qualifying purchase.

Entrants should not publicly display their order number, payment information, address or other sensitive personal information in their social-media content.

5. How to Enter

To receive one main entry, an eligible Australian entrant must:

purchase a qualifying Charlie Bears Mystery Box in accordance with these Terms;
film a video showing the unboxing of that qualifying Mystery Box;
post the unboxing video on Facebook and/or Instagram during the Promotion Period;
tag the official Charlie Bears account @charliebearsofficial in the post; and
ensure that the post is capable of being viewed and verified by Charlie Bears.

It is the entrant's responsibility to ensure that the video has been successfully posted and that @charliebearsofficial has been correctly tagged.

If an entrant's privacy settings or account settings prevent Charlie Bears from viewing or verifying the entry, the entry may be deemed invalid.

6. Facebook and Instagram Entries

A qualifying unboxing video may be posted on:

Facebook;
Instagram; or
both Facebook and Instagram.

Posting the same qualifying Mystery Box unboxing on both Facebook and Instagram does not generate two main entries.

Each qualifying Mystery Box may generate a maximum of one main entry.

For example:

Facebook only = one main entry;
Instagram only = one main entry; or
the same video on both Facebook and Instagram = one main entry.

7. Bearhouse Community Bonus Entry

An eligible entrant may receive one additional bonus entry for each qualifying Mystery Box by also posting the qualifying unboxing video in the official Bearhouse Community Facebook group during the Promotion Period.

Each qualifying Mystery Box may therefore generate a maximum of:

1 main entry + 1 Bearhouse Community bonus entry = 2 entries.

Posting the same qualifying video multiple times in the Bearhouse Community Facebook group will not generate additional bonus entries.

Participation in the Bearhouse Community bonus-entry method is optional.

The Bearhouse Community post must comply with these Terms and the applicable rules of the Facebook group.

8. Multiple Mystery Box Purchases

An eligible entrant who purchases more than one qualifying Mystery Box may receive one main entry for each qualifying Mystery Box.

Each qualifying Mystery Box may also generate one Bearhouse Community bonus entry.

For example, an entrant who purchases and separately unboxes three qualifying Mystery Boxes may receive:

three main entries; and
up to three Bearhouse Community bonus entries.

The entrant must be able to provide reasonable proof of purchase for each qualifying Mystery Box if requested.

Where a single video clearly shows more than one qualifying Mystery Box being unboxed, Charlie Bears may allocate one main entry for each qualifying Mystery Box shown, provided that each qualifying purchase can be verified.

9. Nature of the Prize Draw

This is a game of chance.

The winning entry will be selected randomly.

Entries are not judged on:

originality;
creativity;
entertainment value;
presentation;
production quality;
follower count;
number of likes;
number of comments;
number of shares;
number of views; or
any other social-media engagement metric.

Each valid individual entry included in the global draw will have an equal chance of being selected.

10. Video Requirements

The submitted video must genuinely show the unboxing of a qualifying Charlie Bears Mystery Box.

An entry must not contain content that:

is unlawful;
is defamatory, threatening, discriminatory, obscene or seriously offensive;
promotes illegal or dangerous conduct;
infringes another person's copyright, trade mark, privacy, publicity or other legal rights;
contains third-party material for which the entrant does not have appropriate permission;
materially misrepresents the Mystery Box or its contents;
falsely represents that the entrant purchased or received a qualifying Mystery Box;
contains sensitive financial or personal information;
impersonates another individual;
has been copied from another entrant or creator; or
otherwise breaches applicable Facebook or Instagram terms, policies or community standards.

Entrants must own their submitted video or otherwise possess all rights and permissions necessary to submit it and grant the rights described in these Terms.

11. Children Appearing in Videos

A person under 18 years of age may appear in an unboxing video only where appropriate permission has been obtained from their parent or legal guardian.

Where the entrant is the parent or legal guardian, the entrant confirms that they consent to:

the child's appearance in the video;
submission of the video as a Prize Draw entry; and
Charlie Bears' use of the video in accordance with these Terms.

Where the entrant is not the child's parent or legal guardian, the entrant must have obtained permission from the child's parent or legal guardian before submitting the video.

Charlie Bears may request reasonable evidence of that permission.

If satisfactory evidence cannot be provided where reasonably requested, Charlie Bears may decline to use the video for promotional purposes and may disqualify the entry where appropriate.

12. Music and Other Third-Party Content

Entrants are responsible for ensuring that they have all necessary rights and permissions relating to any:

music;
audio recordings;
photographs;
artwork;
graphics;
video clips; or
other third-party material

included within their entry.

Material being available through Facebook or Instagram does not necessarily mean that Charlie Bears has permission to reproduce or use that material for marketing outside the relevant platform.

Charlie Bears may therefore choose not to repost or otherwise use an entry where third-party rights prevent or restrict its reuse.

13. Permission to Use Submitted Videos

Entrants retain ownership of their original video content.

By submitting an entry, the entrant grants:

Charlie Bears Collectables Australia Pty Ltd;
Charlie Bears Limited;
Charlie Bears North America Inc.;
their respective affiliates; and
their authorised marketing partners

a non-exclusive, worldwide, royalty-free licence to use, reproduce, repost, publish, display, distribute, communicate and share the submitted video for Charlie Bears promotional, advertising and marketing purposes.

This may include use on:

Charlie Bears social-media channels;
Charlie Bears websites;
email marketing;
digital advertising;
promotional campaigns;
online marketing materials; and
other Charlie Bears marketing communications.

Charlie Bears may make reasonable technical or editorial changes including:

resizing;
cropping;
shortening;
adding captions;
adapting formatting; and
adding appropriate Charlie Bears branding,

provided that the entrant's content is not materially misrepresented.

No additional fee, royalty or compensation will be payable for uses authorised under this section.

Charlie Bears is under no obligation to publish, repost or otherwise use any particular entry.

14. One Global Winner

The Prize Draw forms part of a global Charlie Bears Mystery Box promotion.

There will be ONE global winner only.

Eligible entries received through participating Charlie Bears promotions in:

Australia;
the United Kingdom; and
the United States

will be included in the same global winner-selection process.

There will not be a separate Australian, UK and U.S. winner.

The prize received by the global winner will depend on the winner's eligible country or region of residence and the applicable regional Terms & Conditions.

15. U.S. No-Purchase Entry Route

Eligible United States residents participate under separate U.S. Official Rules.

Those rules provide a no-purchase alternate method of entry for eligible U.S. residents.

Valid entries received through that U.S. no-purchase route will be included in the same global Prize Draw.

The existence of a U.S. no-purchase entry method does not create or imply a separate no-purchase entry method for Australian entrants.

Every valid individual entry included in the global draw will receive equal weight when the winner is selected.

16. Australian Prize

If the global winner is an eligible Australian entrant, the winner will receive:

One AUD $360 Charlie Bears Australia website voucher

The Australian prize has a retail value of:

AUD $360

The voucher:

may be redeemed through the official Charlie Bears Australia website at charliebears.com.au;
will be valid for 12 months from the date of issue, subject to any longer period required by applicable law;
may be used across multiple eligible transactions until its available balance has been fully redeemed or it expires; and
is not redeemable for cash except where required by applicable law.

The expiry date will be clearly communicated when the voucher is issued.

Any unused balance remaining following a valid expiry date will expire, subject to applicable law.

The prize is non-transferable except where otherwise agreed by Charlie Bears or required by law.

No cash alternative is available except where required by law.

Where circumstances outside Charlie Bears' reasonable control make the advertised prize unavailable, Charlie Bears may substitute a prize of equal or greater value, subject to any agreement or regulatory approval required by applicable law.

17. Odds of Winning

The odds of winning depend on the total number of valid individual entries received globally during the Promotion Period.

This includes qualifying entries submitted under each participating region's applicable entry rules.

Each valid individual entry will have an equal chance of being selected.

Australian entrants may obtain additional entries only in accordance with these Terms.

Purchasing multiple qualifying Mystery Boxes may generate additional entries as described above.

One Bearhouse Community bonus entry may also be obtained per qualifying Mystery Box in accordance with these Terms.

18. Global Draw

The global winner will be determined by random draw.

The draw will take place on:

8 October 2026

at:

12PM BST

at:

Launceston, Cornwall

The winning entry will be selected using a verifiably random electronic process or random number generator.

The Promoter will retain appropriate records demonstrating the conduct and outcome of the draw.

Entrants do not need to be present at the draw in order to win.

Where independent supervision or any other draw requirement is required by applicable law, the draw will be conducted in accordance with that requirement.

19. Winner Verification

The person associated with the first valid entry selected in the global random draw will be the potential global winner, subject to verification.

Before confirming the prize, Charlie Bears may verify that the selected entrant:

satisfies the applicable regional eligibility requirements;
submitted a valid entry;
complied with the applicable regional Terms & Conditions;
was entitled to each entry attributed to them;
was entitled to any applicable Bearhouse Community bonus entry;
genuinely purchased the qualifying Mystery Box where purchase was required; and
has not otherwise materially breached the promotion rules.

An Australian potential winner may be required to provide:

their qualifying order number;
other reasonable proof of purchase;
proof of identity;
proof of age; and/or
proof of Australian residence.

If the selected entry is invalid or the entrant is ineligible, the prize will be dealt with in accordance with the applicable redraw and unclaimed-prize requirements.

20. Winner Notification

If an Australian social-media entry is selected, the potential winner will be contacted by direct message through the social-media account used to submit the qualifying entry.

Where required, the winner will also be notified in writing.

Charlie Bears will notify an Australian winner as soon as reasonably practicable and, where applicable, within any period required by Australian law.

An Australian winner will be given at least 14 days from notification to claim the prize and complete any reasonable verification requirements.

Charlie Bears will never require a winner to pay a fee or provide payment-card details in order to receive the prize.

Entrants should be alert to fraudulent or impersonating accounts claiming to represent Charlie Bears.

21. Unclaimed Prize and Redraw

If the potential winner:

cannot be contacted after reasonable efforts;
does not claim the prize within the applicable claim period;
cannot be verified;
is determined to be ineligible; or
otherwise forfeits the prize in accordance with applicable law,

Charlie Bears may conduct an unclaimed-prize redraw where permitted and required.

Any redraw will use a random method consistent with the original draw and will be conducted in accordance with applicable Australian state or territory requirements.

Where applicable law requires a particular period to elapse before a redraw can occur, Charlie Bears will observe that period.

Where notice to, or approval from, a regulator is required before an unclaimed-prize redraw, Charlie Bears will comply with that requirement.

A replacement winner will be subject to the same eligibility and verification requirements.

22. Winner Publication

The Promoter will publish winner information where required by applicable Australian law.

For Australian promotional requirements, this may include the winner's:

first-name initial;
surname;
postcode;
state or territory; and/or
social-media handle,

depending on the applicable legal requirement.

The result may be published on a Charlie Bears website, social-media page or other location appropriate to where the Prize Draw was promoted.

Where required by law, the winner information will remain published for the applicable minimum period.

Where an entrant has legitimate privacy concerns, Charlie Bears will consider those concerns subject to any mandatory publication obligations.

23. Invalid, Fraudulent or Manipulated Entries

Charlie Bears may reject or disqualify an entry where it reasonably determines that:

the entry is fraudulent;
the relevant Mystery Box was not genuinely purchased;
a single Mystery Box has been used to generate more entries than permitted;
false eligibility or purchase information has been provided;
multiple or fake identities have been used to circumvent entry restrictions;
automated systems, bots or scripts have been used;
an entry has been copied from another person;
the entry infringes third-party rights;
an entrant has attempted to interfere with or manipulate the Prize Draw;
the entry breaches applicable Facebook or Instagram rules; or
the entrant has otherwise materially breached these Terms.

Charlie Bears may request reasonable evidence before making a decision to disqualify an entry.

24. Mystery Box Returns

Participation in this Prize Draw does not replace, amend or restrict the separate terms applying to the purchase or return of a Charlie Bears Mystery Box.

For Australian purchases, the applicable Charlie Bears Australia Mystery Box Terms & Returns Policy continues to apply.

Nothing in these Prize Draw Terms is intended to exclude, restrict or modify any right, consumer guarantee or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable law.

25. Personal Information

Personal information collected in connection with the Prize Draw may be used for purposes including:

administering the promotion;
recording and validating entries;
conducting the global draw;
verifying the potential winner;
contacting the winner;
supplying the prize;
preventing fraud or abuse;
complying with legal or regulatory obligations; and
administering the rights granted in relation to submitted video content.

Personal information will be handled in accordance with the applicable Charlie Bears Privacy Policy and applicable privacy law.

Entering the Prize Draw does not, by itself, constitute consent to receive unrelated direct marketing communications where separate consent is required.

26. Facebook and Instagram

This Prize Draw is administered by Charlie Bears.

It is:

not sponsored, endorsed, administered by or associated with Facebook, Instagram or Meta Platforms, Inc.

Facebook, Instagram and Meta are not responsible for:

administering the Prize Draw;
verifying entries;
selecting the winner; or
supplying the prize.

Entrants must comply with applicable Facebook and Instagram terms, policies and community standards.

Questions, comments or complaints relating to the Prize Draw should be directed to Charlie Bears and not to Facebook, Instagram or Meta.

27. Social-Media Availability

Charlie Bears is not responsible for entries that cannot be viewed, received or verified because of:

privacy settings;
deletion or removal of a post;
incorrect tagging;
account suspension;
social-media outages;
network or internet problems;
technical failures; or
other circumstances outside Charlie Bears' reasonable control.

Entrants should ensure that qualifying posts remain available and capable of being viewed until the winner has been drawn and verified.

28. Prize Draw Records

Charlie Bears will maintain appropriate records relating to the administration of the Prize Draw, including where applicable:

valid entries;
bonus entries;
the random-selection process;
the identity of the selected entry;
winner verification;
winner notification;
any redraw; and
award of the prize.

Records will be maintained for any period required under applicable Australian law.

Where an Australian regulator is entitled to request information relating to the promotion or electronic draw process, Charlie Bears will provide the required information.

29. Changes, Suspension or Cancellation

Charlie Bears may suspend, modify or cancel the Prize Draw where circumstances outside its reasonable control make this reasonably necessary, subject to applicable law.

Where prior regulatory approval is required for a modification, suspension or cancellation, Charlie Bears will obtain the necessary approval.

Charlie Bears will not alter the promotion merely for the purpose of changing an entrant's legitimate chance of winning.

Where reasonably possible, steps will be taken to minimise unfair disadvantage to entrants who have already submitted valid entries.

30. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other right or remedy that cannot lawfully be excluded, restricted or modified.

Where these Terms conflict with a mandatory requirement of applicable law, the mandatory legal requirement will prevail.

31. Governing Law

For Australian entrants, these Terms are governed by the laws of Victoria, Australia, subject to any mandatory Commonwealth, state or territory law that applies to an entrant or to the conduct of the Prize Draw.

Entrants retain any mandatory rights available under the laws applicable in their state or territory.

32. Acceptance of Terms

By entering the Charlie Bears Mystery Box Unboxing Prize Draw, each entrant confirms that they have read and agree to these Terms & Conditions.

Failure to comply with a material requirement of these Terms may result in disqualification.
